"SUMMER FUNDS" INSTANT WIN GAME

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. GAME/SWEEPSTAKES BEGINS AT 12:00:00 PM (NOON) (ET) ON 6/1/09 AND ENDS AT 11:59:59 AM (ET) ON 12/31/09.

1. GAME PIECES: An official game piece ("Game Piece") is required to play. Game Pieces are available on the inside of specially-marked packages of SKITTLES® Brand and STARBURST® Brand products. For a free Game Piece (while supplies last) and/or a copy of these Official Rules, send a self-addressed, stamped envelope to Summer FUNds Free Game Piece Requests, PO Box 9227, Medford, NY 11763-9227. (VT residents may omit return postage.) Game Piece requests must be received by 12/17/09. Limit: one Game Piece request per outer envelope. Game ends 12/31/09. Game Pieces are not transferable and are void if defaced, mutilated, forged, illegible, reproduced, altered and/or not obtained through authorized channels.

2. TO PLAY INSTANT WIN GAME: If Game Piece says "Congratulations!", you win prize indicated, subject to verification of eligibility and compliance with these Official Rules.

3. PRIZES AND ODDS OF WINNING (ASSUMING DISTRIBUTION OF ALL GAME PIECES): 54 Grand Prizes: A $250 prepaid smartOne® Visa Gift Card. Odds: 1:1,103,498. 1,000 First Prizes: A $100 prepaid smartOne® Visa Gift Card. Odds: 1:59,589. 16,860 Second Prizes: A $50 prepaid smartOne® Visa Gift Card. Odds: 1:3,534. 2,435,816 Third Prizes: A coupon redeemable for one (1) single-size package of SKITTLES® Bite Size Candies, STARBURST® Fruit Chews or STARBURST® GUMMIBURSTS® Liquid Filled Gummies; Approximate Retail Value ("ARV"): $0.99 each. Odds: 1:24. Total ARV of all prizes: $3,367,957.84. Visa Gift Cards are issued by First National Bank of Omaha ("FNBO") pursuant to a license from Visa USA, Inc. and are subject to all applicable FNBO terms and conditions, including but not limited to a monthly maintenance fee of $2.50 assessed to Gift Card's balance beginning in the 7th month after its issue date and a closure fee of $25 at time of Gift Card's stated expiration. Coupons must be redeemed in accordance with, and are subject to, terms and conditions printed thereon. Additional restrictions, limitations and exclusions may apply. Sponsor reserves right to substitute prizes of equal or greater value. No other substitution or transfer of prizes permitted. Sponsor responsible only for delivery of prize; not responsible for prize utility, quality or otherwise. Taxes and fees, if any, are the sole responsibility of winners. PRIZE LIMIT: AGGREGATE VALUE OF ALL PRIZES RECEIVED CANNOT EQUAL OR EXCEED $600 PER PERSON. The $599.99 per person prize limit for this Game/Sweepstakes will be reduced by the retail value (as determined by Sponsor) of all prizes received from Sponsor as a result of participation in this or any other promotion sponsored by Sponsor during 2009. If Sponsor discovers that any prize(s) won in this Game/Sweepstakes would cause any person to exceed the $599.99 limit, such prize(s) will not be awarded and no partial payment of any such prize will be awarded.

4. INSTANT WIN PRIZE CLAIMS: To claim your Grand, First or Second Prize, visit www.skittles.com or www.starburst.com, complete the claim form and enter the official winning code printed on your Game Piece. ALL PRIZE CLAIMS MUST BE RECEIVED BY 11:59:59 AM (ET) ON 12/31/09. Allow 6-8 weeks for delivery of Grand, First and Second prizes. Unclaimed Grand, First and Second Prizes will be awarded in the Second Chance Sweepstakes described in Rule 5 below (assuming sufficient number of eligible entries). Other unclaimed prizes will not be awarded. No more than the stated number of prizes will be awarded. In the unlikely event that winning Game Pieces for any prize level are distributed in a number greater than the number stated in these Official Rules for such prize levels, that stated number of winners will be selected in a random drawing from among all verified prize claims received for that prize level.

5. SECOND CHANCE SWEEPSTAKES: Grand, First and Second Prizes not claimed by 11:59:59 AM (ET) on 12/31/09 will be awarded in the Second Chance Sweepstakes (the "Sweepstakes"), assuming a sufficient number of eligible entries. To enter the Sweepstakes, print your name, address and telephone number and age on a 3" x 5" piece of paper and mail to: Summer FUNds Second Chance Sweepstakes, PO Box 9239, Medford, NY 11763-9239. ALL SWEEPSTAKES ENTRIES MUST BE RECEIVED BY 12/31/09. No mechanically reproduced, illegible, incomplete, forged or altered entries will be accepted. Winners will be determined from all eligible entries received in a random drawing to be conducted on or about 1/21/10. Odds of winning depend upon the number of eligible entries received. Winners will be subject to the Prize Limit set forth in Rule 3 above. Winners will be notified by mail.

6. ELIGIBILITY: Game/Sweepstakes open to individual legal residents of the United States (including Puerto Rico and U.S. territories and possessions), age 13 or older as of 6/1/09, except employees (and their immediate families and members of the same household) of Sponsor and its affiliates, agents, judges and advertising and promotion agencies.

7. VERIFICATION OF WINNERS AND DELIVERY OF PRIZES: Prize claims subject to verification, and Sweepstakes drawing to be conducted, by Ventura Associates, Inc., an independent judging organization, whose decisions are final on all matters relating to this Game/Sweepstakes. Winners may be required to sign affidavits of eligibility and liability releases and, where permitted, publicity releases. Any prize may be awarded to alternate winner if affidavit/release is not returned within 10 days after mailing to winner or if the prize or affidavit/release is returned as undeliverable. If a prize is won by a minor, it may be awarded in the name of a parent or legal guardian in Sponsor's sole discretion. Each winner agrees to use of his/her name, address, likeness and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law, any such use with respect to a minor subject to prior approval of a parent or legal guardian. Prize claims and Sweepstakes entries are the sole property of Sponsor and will not be returned.

8. GENERAL: This Game/Sweepstakes is void outside the United States and where prohibited or restricted by law and subject to all applicable federal, state and local laws and regulations. This Game/Sweepstakes will be governed by the internal laws of the State of Delaware. Any and all legal actions or claims arising in connection with this Game/Sweepstakes must be brought in a court of competent jurisdiction within the United States of America. Sponsor and judges not responsible for: late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due or misdirected entries, mail or communications; for errors, omissions, interruptions, deletions, defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices or transmission lines; or data corruption, theft, destruction, unauthorized access to or alteration of entry materials; loss; or otherwise. Further, Sponsor and judges not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's e-mail account to receive e-mail messages. The use of automated software or computer programs to play/enter the Game/Sweepstakes is prohibited and any individual who uses or attempts to use such methods to play/enter will be disqualified. Sponsor disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Game/Sweepstakes, and reserves the right, at its sole discretion, to modify, cancel, terminate or suspend this Game/Sweepstakes should any virus, bug, technical failures, unauthorized human intervention or other cause beyond Sponsor's control corrupt or affect the administration, security, fairness, integrity or proper conduct of this Game/Sweepstakes. In the event of any such cancellation, termination or suspension, a notice will be posted, all eligible, non-suspect prize claims received prior to such time will be honored and a random drawing will then be held from among all eligible, non-suspect entries received for the Sweepstakes prior to such time. Sponsor reserves the right, at its sole discretion, to disqualify any entrant (and all of his/her entries) from this Game/Sweepstakes or any other promotion conducted now or in the future by Sponsor or any of its affiliates if he/she tampers with the entry process or if his/her fraud or misconduct affects the integrity of this Game/Sweepstakes. Sponsor reserves the right to correct clerical or typographical errors in promotional materials. By participating in this Game/Sweepstakes, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the judges and warrants that he/she is eligible to participate in this Game/Sweepstakes. By accepting prize, winner agrees to release Sponsor and its directors, employees, officers and agents, including without limitation, its advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt and/or use or misuse of prize or participation in any prize-related activity.

9. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GAME/SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
